What is the New Statewide Bond Schedule?

The Florida Supreme Court issued this landmark ruling in Case No. AOSC25-69 on December 18, 2025. For the first time in Florida history, there is now a standardized framework for setting bail amounts before a defendant's first court appearance.

Previously, bail amounts could vary significantly from county to county for the same offense. A person arrested in Lee County might face a different initial bail amount than someone arrested for the identical charge in Miami-Dade County. This new schedule aims to create consistency and fairness across the state.

The schedule establishes bail amounts ranging from $150 to $5,000, depending on the nature and severity of the alleged offense. These amounts apply when law enforcement, jail personnel, or pretrial release employees set bail before the defendant appears before a judge.

Key Points You Need to Understand

This schedule applies BEFORE your first court appearance. When you're initially arrested and processed at the county jail, the booking officers now have a standardized guide for setting your initial bail amount.

Judges are NOT bound by this schedule. Once you appear before a judge for your first appearance hearing, the judge has full discretion to adjust the bail amount based on the specific circumstances of your case.

Local jurisdictions can set higher amounts. Chief judges in each circuit have the authority to establish local bond schedules that increase the amounts above the statewide minimum.

The schedule expires December 31, 2026. This is a temporary measure that will be reviewed and potentially revised before the end of the year.
