An indemnitor — also called a co-signer — is the person who signs the bail bond agreement and takes legal responsibility for ensuring the defendant appears at all court dates. If the defendant fails to appear, the indemnitor may be liable for the full bail amount. Before you co-sign a bail bond for a friend or family member, it is essential to understand exactly what you are agreeing to. This guide explains the indemnitor's role, responsibilities, and risks. What Does an Indemnitor Do? As the indemnitor, you are making a legally binding promise to the bail bond company and the court that the defendant will appear at all scheduled court dates. You are essentially vouching for the defendant with your financial assets. What Are the Financial Risks? For example, if bail was set at $50,000 and you co-signed the bond, you could be required to pay $50,000 to the bondsman.
